SARS wants proof of expense claims made in husband's name, but I'm paying.

By Marc Sevitz · Updated

I'm currently a independent contractor and submitted my tax for office space, but my problem is the utilities and this are in my husbands name, although I'm paying it. SARS want proof. Can I submit although it's in his name? I have disputed.

Do you have proof that you pay for these expenses?

Yes I do, also my husband pays for the medical aid. How would the new law for medical aid help me in submitting my tax?

If you submit those expenses and SARS requests an audit then along with all your supporting documentation you would need to include the bank statements or whatever proof you have that you pay for these expenses as well as a letter indicating why and how you pay for the expenses yet they are in your husband's name.

The medical aid law only provides a credit against the income tax payable depending on the number of members. It it just a change in the way the benefit is calculated.
