Refunded but still owe SARS money?

I got a refund last year (2012) and went into SARS and they did my submission for me. I phoned SARS to see how to report my previous company as they have not let me have my IRP5 form as yet (it was due by July 2013). I was then informed that I have a recurring penalty of R 13750.00 due to 2007 and 2011 not being submitted.

Surely if I owed them any money they would not have released the refund for 2012? I really need help with this as I am pretty confused.

I went there yesterday and they say it is an outstanding submission from 2007. I need to pay before I can dispute it. Please advise! It is R250 per month plus interest from 2007.

Why did you not submit your returns for those years? Did you assume your employer had done this for you?

My Dad was unemployed and I paid him to submit for me. He had told me he had done it but failed to. Do you think that I can ask for leniency?

You can apply for leniency from SARS, there are special forms to complete, but you would need to go into your nearest SARS Branch in order to do so.
